you attack someone and once you defeat someone you usually get the 3 options to: leave, mug, hosp. Arrest will appear as a 4th option.

You will have the chance to be able to arrest someone once they have built up a certain about of crimes done since their last arrest.

Arresting is a job special , if your wanted amount is high enough , a person working in detective agency beats you , arrest is one of the options at end of fight .
If your curious because of Duke mission in which you need to be in jail . The best thing to do is fail to bust someone out of jail so you don't hurt your crime experience . Easiest way just try to bust out the first person on list of people jailed .

Your reward als goes up for doing crimes without going to jail so if you do a lot of arsons your reward will be a lot higher then someone doing drug crimes.
Been arrested a few times and didn't notice any negative effects other then ending up in jail. Not sure but I don't think it effects your CE.
