It gives jail time if you don't have enough cash on hand to pay the fine.

at the wiki at (the crimes link (https://wiki.torn.com/wiki/Crime#Kidnapping) you can see the $ in hand for each kidnap to prevent the jail; if you are doing kidnap woman as substitute for Arson a jail result quite makes hard to break even so is good to always have the $ in hand;
