Because it's a faction of big, rich players? I didn't see any white knights when a faction of hard working noobs got scammed out of Born Fighting.

I think there is too much grey area to be covered by the official rules.
Batman was given lead of Monarch. While I think everyone would consider Hank to be the spiritual owner, the game doesn't recognize a faction as property that can be lent out; hence why you can't add a faction in the trade window.
Who paid for it? Who contributed to it? If Hank is gone, then who should it be handed off to? The oldest serving member?
Stealing a faction is an atrocity that backstabs everyone who built it. But that is a LOT for staff to try to untangle, and noone will ever be happy with the results.
