To actually answer your question, your crime status doesn't matter. The graffiti mission is to pepper spray the person, it has nothing to do with the crime.
You should still swap to Crime 2.0 though.

You have to complete the tutorial missions before you can switch to crimes 2.0 they might need to change the tutorial a little bit before that’s possible

This is unfortunately incorrect. As of right now, accessing crimes 2 is locked behind one of the earlyish missions from George. Ched really ought to change that so that you are immediately transitioned to the new system, it’s far better for early game engagement.
Ah and here I thought suddenly crimes are involved with missions, oh well with no offense they are a greenleaf so....
