I reached level 100, got the merit but I noticed the level dropped back to 99 after I had a few failures.

That is expected behavior, you can lose crime skill and thus crime levels on failures.
A bit pointless moving back down levels after you hit 100, no?
There are more uses of crime skill than just the merit.
No? Think of it as "losing your edge" and getting a bit too cocky thinking you were the best...
You still gain "hidden" skill level experience after getting to 100, it just doesn't change your odds of success once past 100
(At least not in the crimes - it may still make a difference in OCs 2.0)
Is really no different to your skill dropping after a critical failure BEFORE hitting 100. If it doesn't make sense at 100, it doesn't make sense before 100 either...
This has nothing to do with OC 2.0. You failed a crime and lost Level 100. You can still drop below Level 100, you are not guaranteed to keep it all times.
